Welcome to Tando. These Terms of Service ("Terms") govern your access to and use of the Tando mobile application and website (the "Service"). By creating an account or using Tando, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Eligibility
To use Tando, you must: • Be at least 18 years of age. • Be legally able to enter into a binding agreement. • Not be prohibited from using the Service under applicable laws. • Not have been previously banned or removed from Tando. By creating an account, you represent and warrant that you meet all of the above requirements.
2. Account Creation and Security
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to: • Provide accurate, current, and complete information during registration. • Update your information as needed to keep it accurate. • Not create more than one account. • Not share your account with others or allow others to access your account. • Notify us immediately of any unauthorized access to your account. We reserve the right to suspend or terminate accounts that contain inaccurate, false, or misleading information.
3. Acceptable Use
Tando is a dating platform designed for Afro singles seeking genuine, long-term relationships. You agree to use the Service in good faith and in a manner consistent with its intended purpose. This means: • Being honest and respectful in your profile and interactions. • Using real, recent photos that accurately represent you. • Engaging in conversations with genuine intent. • Respecting other users' boundaries and preferences. • Reporting any suspicious or inappropriate behavior.
4. Prohibited Conduct
You agree not to: • Harass, threaten, intimidate, or abuse any user. • Send unsolicited sexual content or messages. • Impersonate any person or misrepresent your identity, age, or affiliations. • Use the Service for commercial purposes, advertising, or solicitation. • Attempt to gain unauthorized access to the Service, other users' accounts, or our systems. • Upload malicious software, viruses, or harmful code. • Scrape, data mine, or use bots or automated tools to access the Service. • Violate any applicable laws or regulations. • Create fake profiles or use the platform to deceive others. Violation of these rules may result in immediate account suspension or permanent ban, at our sole discretion.
5. User Content
You retain ownership of the content you upload to Tando (photos, bio, messages). By uploading content, you grant Tando a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content solely for the purpose of operating and improving the Service. You are responsible for the content you post. Content that is illegal, offensive, discriminatory, sexually explicit, or violates the rights of others may be removed without notice. We reserve the right to review and remove any content that violates these Terms.
6. Subscriptions and Payments
Tando offers free and premium subscription tiers. If you purchase a premium subscription: • Payment will be charged to your App Store or Google Play account. • Subscriptions automatically renew unless cancelled at least 24 hours before the current period ends. • You can manage or cancel your subscription through your device's app store settings. • Refunds are handled according to the policies of Apple App Store or Google Play Store. We reserve the right to change subscription prices with reasonable notice. Price changes will not affect your current subscription period.
7. Termination
You may delete your account at any time through the app settings. Upon deletion, your profile will be removed from the platform and your personal data will be handled according to our Privacy Policy. We may suspend or terminate your account at any time if you violate these Terms, engage in prohibited conduct, or if we believe your actions may cause harm to other users or to Tando. In cases of serious violations, termination may occur without prior notice.
8. Disclaimers
Tando is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that: • The Service will be uninterrupted, secure, or error-free. • Any matches will result in successful relationships. • Other users' profiles are accurate or truthful. • The Service will meet your specific expectations. While we take measures to verify profiles and maintain community standards, we cannot guarantee the identity, intentions, or behavior of any user. You are responsible for your own safety when interacting with others through Tando.
9. Limitation of Liability
To the fullest extent permitted by law, Tando and its founders, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, arising from: • Your use of or inability to use the Service. • Any conduct or content of other users. • Unauthorized access to your account or data. • Any other matter relating to the Service. Our total liability for any claims arising from these Terms or the Service shall not exceed the amount you paid to Tando in the 12 months preceding the claim.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Switzerland, without regard to conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the competent courts of Switzerland. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
11. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you through the app or via email and update the "Last updated" date. Your continued use of Tando after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you should stop using the Service and delete your account.
